Whole process to remove FNU from passport, I-94, I-797, SSN after or before coming to USA on H1B and get a new visa with correct name

  Apply new passport in USA.

             Name on Passport 

                     Given Name        :              <FirstName>  <LastName>

                     Surname              :                    

             Name on Visa

                     Given Name        :            FNU  

                     Surname             :             <FirstName>  <LastName>

 ·       Requested for a new passport at Washington DC – Via mail.

 ·       I was splitting my name so I did not need any newspaper add (Check latest passport rule on website).

 ·       Follow the instructions to and submit required documents/Forms. 

  Order Form - Fill all the details.

 ·       Deep poll affidavit for splitting name  - Duly notarized Sworn Affidavit for change of name.  

Deep Poll example: If your Name On Passport is as below:-

                 Given Name        : Abc Xyz

Surname               :  

   File H1B amendment with USCIS

 ·       I filled my petition in premium to save time.

 ·       Got new I-797 with new I-94 attached to it with correct name and new validity. 

 ·       Your stay will be counted on the basis of new I-94 that you receive with I-797.

   Correct Name on SSN

 ·       Went to SSN office and showed new I-94 and it was corrected in a moment and got new SSN in one week.

  Things to remember while going back to India

 ·       Tear of your I-94 attached to I-797 and give to airline while taking boarding passes as this is your current I-94 (I have done the same) but online records still showed old name on port of exit as well..does not matter.

 ·       There is no exit stamp while going back to US so no worries which passport you need to give for stamping.

 ·       While entering India, give your new passport for entry stamp as this is your valid passport and old one is cancelled with valid Visa.

  Visa Stamping at New Delhi consulate 

·     I took drop-box option so I dropped my passport and other documents along with old passport.

·     Visa went to Admin process and got a call from embassy to ask that you current Visa is still Valid and new petition is approved less than current Visa. They called me to ask which validity you want (that was quite funny).

·     Visa approved and collected my passport.

  While coming back to States 

·    Give your new passport while immigration from India and they will stamp port of exit stamp on your new passport.

·    Give your new passport with new valid visa while POE in United States and then officer will stamp entry stamp on your new passport.

·    Wait for 2-5 minutes and login to I-94 website, your correct records will be shown in 5 minutes and if something is wrong you can speak to officer at the same time instead coming to CBP office again.

  Correct passport before coming to USA to avoid all the above issues.

·     Try to correct passport before applying I-129.

   If you have already applied for I-129 and got I-797 with name LNU or FNU then follow below steps.

·     Apply for new passport in Tatkal and you will get both passports, one with cancelled and new one with correct name.

·     Fill DS-160 as per new passport/correct name.

·     Give both passports while stamping and you will get Visa stamped as correct name.

·     Show your new passport at POE. Also keep old one with you. Please show them if they ask you.

·     Now you will get first I-94 with correct name and you are good to go.
